Beyond Gonzales

For most of the pols in DC and the talking heads on TV, the fate of US Attorney General, Alberto Gonzales is almost as juicy a bet as which team will win the playoffs, or the Super Bowl.

              I’ve heard that Lloyd’s of London is even offering odds.

              But, believe it or not, ‘Fredo’ Gonzales isn’t the issue. The firings aren’t the issue either.

              That’s because under the Orwellian terms of the Patriot Act, the AG has broad authority to name or dismiss US Attorneys (or USAs) without congressional approval.

              Just as Congress ceded authority to the President to declare war anywhere (under the Authorization for Use of Military Force (AUMF), 115 Stat. 224), it granted authority to the AG to O.K. of nix USAs.

              While Gonzales has almost certainly lied over his role and the role of the White House in the firings, the point remains—Congress specifically gave him this power.

              The Patriot Act was a virtual grab bag of executive power, designed to make Congress almost irrelevant. It was a law born in fear, and nurtured in anxiety. It was midwifed in the still unsolved anthrax mail attack on the Capitol, while administration officials were warning of “mushroom clouds” and “weapons of mass destruction.”

              This is not just the writer’s view.

              Several years ago, Repunlician congressman Don Young (of Alaska) expressed grave misgivings about congressional voting during that period. He told a radio caller from Hooper Bay, Alaska:

              “The events of September 11, as horrendous and horrible as they were, have had           

              an even more horrendous affect—in my opinion and I think in the opinion of a

              lot of Americans—on our rights, through much of the legislation that has been

              passed as the USA PATRIOT Act. The worst act we ever passed.”

              “Did you vote for it?” the caller asked?

              “Everybody voted for it,” Don Young said, “but it was stupid. It was what you

              Congress is as much responsible for the Attorney General as Gonzales is, for

when you cede great power to the executive, how can you not expect them to abuse it?

              What is the history of executive power, without abuse of it? What else were the Palmer Raids, J. Edgar Hoover’s mad obsession with, and conspiracies against Martin Luther King Jr., COINTELPRO, or Watergate but illegal, unconstitutional abuses of executive power?

              To grant such power to the State is like giving a 6-year old a loaded submachine gun—it’s stupid!

              The political fixation on Gonzales is ultimately woefully misplaced. The attention ought to be on the Congress, and the demand should be, instead of a Gonzales resignation, a repeal of the Patriot Act.
